You need to look at your rental agreement to see if there is a clause about "enjoyment" or something similar that states how you are protected from invasions of your privacy.

If you are renting in California, you probably have more remedies than people in other states. If there is a Renter's Union or help for renters, you need to contact them quickly. The longer you wait, the more likely that delay will be argued as a sign that his presence hasn't bothered you at all.
